TERMS OF SERVICE

These Terms of Service ("Terms") govern the relationship between you and Guttae AB, a Swedish company (Org.nr 559266-9948), with its registered office in Stockholm, Sweden (hereinafter "Guttae", "us", or "we"), regarding your use of the Daily Pact mobile application and related services (the "Services"). Use of the Services is also governed by our Privacy Policy, which is incorporated herein by reference.

BY REGISTERING FOR, USING OR OTHERWISE ACCESSING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

You represent and warrant that you are at least 13 years of age, or that you have your parent or legal guardian's permission to use the Services. Persons under the age of 13 are prohibited from creating accounts.

1. THE SERVICES

Daily Pact is a social accountability application that allows users to create private groups, set daily and weekly challenges, and track progress with friends. The Services include the mobile application, backend infrastructure, and any related websites or tools provided by Guttae AB.

2. ACCOUNTS AND REGISTRATION

To use key features of the Services, you must create an account using a supported authentication method (such as Apple Sign-In). You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

You agree to provide accurate information and to keep your account details up to date. You must notify us immediately of any unauthorized use of your account.

3. USE OF THE SERVICES

Subject to these Terms, Guttae grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial purposes. You agree not to:

4. GROUPS AND CONTENT

Users can create private groups and invite others via invite codes. As a group owner, you are responsible for managing your group. You may transfer ownership or remove members at any time.

You retain ownership of any content you submit through the Services. By submitting content, you grant Guttae a worldwide, non-exclusive, royalty-free license to use, store, and display that content as necessary to provide the Services.

5. SUBSCRIPTIONS AND PAYMENTS

Daily Pact offers both free and premium ("Pro") tiers. The free tier includes limited functionality. The Pro tier is available through in-app purchase subscriptions (monthly, yearly) or a one-time lifetime purchase.

Subscriptions are processed through the Apple App Store or Google Play Store. All payments are subject to the terms and conditions of the respective platform. Subscription renewals are automatic unless cancelled at least 24 hours before the end of the current billing period.

Guttae reserves the right to change subscription pricing at any time. Price changes will not affect existing active subscription periods.

6. FREE TIER LIMITATIONS

The free tier of Daily Pact is subject to the following limitations:

Guttae reserves the right to modify free tier limitations at any time.

7. TERMINATION

You may delete your account at any time through the app settings. Guttae may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease.

If you own groups at the time of account deletion, you must transfer ownership first or the groups will be deleted.

8. INTELLECTUAL PROPERTY

The Services and all related content, features, and functionality (including but not limited to design, logos, text, graphics, and software) are owned by Guttae AB and are protected by Swedish and international intellectual property laws.

9. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. GUTTAE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE SERVICES AT YOUR OWN RISK.

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GUTTAE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICES.

IN NO EVENT SHALL GUTTAE'S TOTAL LIABILITY EXCEED THE AMOUNTS PAID BY YOU TO GUTTAE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Guttae AB, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Services or your violation of these Terms.

12. MODIFICATIONS TO THE SERVICES

Guttae reserves the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice. Guttae shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

13. CHANGES TO THESE TERMS

Guttae may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the Services or by other reasonable means. Your continued use of the Services after such changes constitutes acceptance of the updated Terms.

14. GOVERNING LAW AND DISPUTES

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Stockholm, Sweden.

15. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
